Terms of Service

1. Who we are and what this covers

These Terms of Service (the “Terms”) are a contract between you and MailStrap LLC, a Colorado limited liability company (“MailStrap”, “we”, “us”), and govern your use of the MailStrap service at https://mailstrap.com: email hosting on your own domains, cloud storage, documents, calendars and tasks, video meetings, marketing campaigns, and electronic signatures (together, the “Service”).

By creating an account or using the Service you accept these Terms, our Privacy Policy, and our Acceptable Use Policy. If you use the Service on behalf of an organization, you accept them for that organization and confirm you have authority to do so.

2. Your account

  • You must provide accurate information, keep your credentials secure, and verify your email address.
  • You are responsible for all activity under your account and for everyone you invite into your organization.
  • You must be at least 16 years old (or the minimum age of digital consent where you live) to use the Service.
  • We may suspend accounts that violate these Terms, the Acceptable Use Policy, or that put the platform's security or email deliverability at risk.

3. Plans, billing, and auto-renewal

Paid plans are billed monthly, in advance, through our payment processor Stripe. By subscribing you authorize us to charge your payment method on a recurring basis.

  • Subscriptions renew automatically each month until you cancel.
  • You can cancel at any time from Billing in your workspace. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Metered add-ons (such as extra storage) are billed at the rates shown at purchase time.
  • Prices may change; we will give at least 30 days notice by email before a price change affects an existing subscription.
  • Taxes are added where we are required to collect them.

Refunds are handled per our Refund & Cancellation Policy.

4. Your content

You own your content: email, files, documents, contacts, campaign material, and anything else you store in the Service. We claim no ownership of it. You grant us only the limited rights needed to operate the Service, storing, transmitting, backing up, and displaying your content to you and the people you share it with.

You are responsible for your content and for having the rights to send what you send. Marketing email through the Service must comply with the Acceptable Use Policy and applicable law (including CAN-SPAM and GDPR).

5. Our service

  • We work to keep the Service available and performant, but it is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We may change or discontinue features; if we discontinue the whole Service we will give you at least 60 days notice and a way to export your data.
  • Some features rely on third-party providers (payment processing, content delivery, AI). Their availability can affect those features.

6. Limitation of liability

To the maximum extent permitted by law, MailStrap will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

7. Termination

  • You may stop using the Service and delete your account at any time from Settings, or as described on our account deletion page.
  • We may suspend or terminate accounts for material breach of these Terms or the Acceptable Use Policy. Where practical we will notify you and give you a chance to fix the issue first.
  • On termination, your right to use the Service ends. Data deletion and retention are described in the Privacy Policy.

8. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Colorado, and both parties consent to their jurisdiction.

9. Changes to these Terms

We may update these Terms. Material changes will be posted on this page with a new effective date, and for significant changes we will email account owners. Continued use of the Service after a change means you accept the updated Terms.
